Terms of Use

These Terms of Use ("Terms") govern your use of amiunderpaid.online (the "Site") and the payslip-check service (the "Service"), operated by Am I Underpaid? ("we", "us", "our"). By using the Site or Service, you agree to these Terms. If you don't agree, please don't use the Site.

1. What we do

Am I Underpaid? helps Australian workers check whether their pay may be incorrect. We offer a free, estimate-based check of a payslip you choose to send us, and, optionally and only if you ask for it, a paid "claim-back pack" with figures and a template letter. We are currently operating a waitlist.

The Service provides general information and estimates only. It is not legal, financial, taxation or other professional advice, and using it does not make us your lawyer or adviser. Our estimates may be wrong or incomplete and are not a substitute for advice from the Fair Work Ombudsman, a registered union, a lawyer, or your superannuation fund. For anything important, please seek independent professional advice.

2. Eligibility

You must be at least 18 years old and a worker in Australia to use the Service.

3. Your information and payslips

You're responsible for the information you give us. By sending a payslip or other details, you confirm that you're entitled to share them and that they relate to your own employment. Please don't send information you're not authorised to share, or sensitive identifiers we don't need (such as your tax file number or bank details). We handle your information as described in our Privacy Policy.

4. No guarantee of results

We don't guarantee that we'll find an underpayment, that any estimate is accurate, that you're entitled to recover any amount, or any particular outcome if you pursue a claim. Award, pay and superannuation rules are complex and change over time.

5. The optional claim-back pack (paid)

If you choose to purchase the claim-back pack, the price and conditions shown at the time of purchase apply. Our current offer is that you only pay if we identify money you may be owed, with a refund available if you're not satisfied. The specific conditions shown at checkout govern. 6. Acceptable use

You agree not to misuse the Site. In particular, you must not: use it for any unlawful purpose; attempt to breach its security or access data you're not entitled to; scrape or use automated means to collect data; submit another person's information without their authority; or interfere with the Site's normal operation.

7. Intellectual property

The Site and all of its content, including its design, text, graphics, logos and code, are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-transferable licence to use the Site for its intended purpose. You may not copy, reproduce, republish or otherwise exploit any part of it without our permission. All rights reserved.

8. Third-party links and references

References to organisations such as the Fair Work Ombudsman, or to any employer, are for information only and do not imply any affiliation with, or endorsement by, those organisations.

9. Disclaimers

To the maximum extent permitted by law, the Site and Service are provided "as is" and "as available", without warranties of any kind. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for any loss arising from your reliance on the Service's estimates or information. Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the Service (or paying the cost of having it re-supplied).

11. Indemnity

You agree to indemnify us against claims, losses and costs arising from your misuse of the Site or your breach of these Terms.

12. Changes and availability

We may change, suspend or discontinue any part of the Site or Service at any time. We may also update these Terms; the current version always lives on this page with the "last updated" date, and your continued use means you accept the changes.

13. Governing law

These Terms are governed by the laws of [State / Territory], Australia, and you submit to the courts of that jurisdiction.
